11/12/02 Dead Kennedys Respond to New Lawsuit Brought by Former Band Member Jello Biafra On September 27, 2002, Dead Kennedys original band members East Bay Ray, Klaus Flouride and D.H. Peligro filed an answer and cross-complaint in response to a new lawsuit filed against them by former band member Jello Biafra. Biafra's lawsuit was filed in Alameda Superior Court in February 2002. Dead Kennedys band members were required by law to make a formal response to the Biafra lawsuit and did so this September. Contrary to Biafra’s statements to the media, Ray, Klaus and D.H. did NOT file a new lawsuit against Biafra and his record label, Alternative Tentacles Records. Dead Kennedys are committed to putting Biafra’s and his labels' fraudulent actions behind them and are eager to move forward. Not only has Biafra failed in his attempts to sway the courts with his baseless legal proceedings and choosing to waste his time and money by being litigious, he has also failed with the fans who continue to sell out Dead Kennedys’ live shows with new lead singer Brandon Cruz.
